These Terms of Service ("Terms") govern your engagement with and use of services and products provided by Indi Creative, a Florida-based business (hereinafter referred to as "Indi Creative," "We," "Us," or "Our"). By purchasing, scheduling, or using any of Our services or products, you ("Client," "You," or "Your") agree to be bound by these Terms.

1. Services Offered

Indi Creative provides a range of professional photography and media services, including commercial, branding and events. This includes, but is not limited to, high-end property shoots, commercial photography such as products and locations, content creation for marketing purposes, and per-image licensing for print and/or web use (where applicable).

2. Scheduling & Appointments

  • Weather Conditions: We endeavor to select shoot times that consider weather; however, ensuring favorable conditions at the scheduled time is ultimately the responsibility of the Client.

  • Right to Reschedule: Indi Creative reserves the right to reschedule appointments based on logistical needs, weather, or safety factors. You will be notified via phone, text, or email as soon as possible.

  • Confirmation: We will confirm Your appointment one (1) hour prior to Our departure to the shoot location.

3. Travel & Parking

  • Mileage: Charges are waived for most appointments. If a location involves a round-trip distance of one hundred (100) miles or more from Our team’s current location, a travel fee of $1.00 per mile for the excess mileage will be added to the invoice.

  • Parking: Any parking fees incurred during the shoot will be itemized and billed directly to the Client.

4. Investment & Payments

  • Cancellation Credit: If a service is cancelled by the Client with proper notice and has been paid in full, the amount may be credited to Your account for future services (valid for one year). No cash refunds will be issued.

  • All Sales Final: All sales for services and licensed images are final. Indi Creative does not offer money-back guarantees.

  • Payment Requirement: The license to use any images is strictly contingent upon receipt of full payment. Use of images prior to payment is a violation of these Terms.

5. Rescheduling & No-Show Fees

  • Late Cancellation: Cancellations made with less than forty-eight (48) hours' notice will incur a $100.00 fee.

  • No-Shows: If the point of contact doesn’t show 30 minutes past the scheduled booking time, a $100.00 fee applies.

  • On-Site Cancellation: If an appointment is cancelled or rebooked on-site after Our one-hour pre-departure confirmation, a fee of 35% of the total session cost will apply.

6. Location Readiness

The Client is solely responsible for ensuring the location is "shoot-ready" prior to arrival (e.g., lights on, decluttering, vehicles removed). If a reshoot is required because the property was not ready, a fee of $150.00 (or higher depending on scope) will be applied.

7. Creative Discretion & Delivery

  • Artistic Style: Indi Creative retains full creative discretion over shot selection, composition, and editing style.

  • Delivery Timeline: Final edited photographs are typically delivered within 2–5 business days. Complex projects may require up to 7 business days.

  • Revisions: The first round of reasonable revisions is complimentary. Subsequent rounds or out-of-scope requests are billed at $100.00 per hour (one-hour minimum).

8. Rights & Licensing

  • Ownership: All photographs and media created by Indi Creative remain the sole and exclusive property of Indi Creative.

  • Client License: Upon full payment, Client is granted a non-exclusive, non-transferable license to display the images solely for the marketing and sales.

  • Usage Restrictions: You may not edit, re-sell, or transfer these images to third parties (such as contractors, business partners/affialites or other parties) without express written consent.

  • Promotional Use: Indi Creative reserves the right to use any captured media for its own marketing, portfolio, and social media purposes.

9. Liability & Safety

Indi Creative reserves the absolute right to postpone or cancel a shoot if conditions are deemed unsafe for our personnel or equipment. Our aggregate liability for any claims shall not exceed the total amount paid by You for the specific services in question.

Governing Law: These Terms are governed by the laws of the State of Florida.

  • Client Management: For reaching out about additional services, etc.

3. Discretion & Third-Party Sharing

Indi Creative does not sell or rent your personal or property data to third parties. We only share information with trusted partners necessary to fulfill our services, such as:

  • Gallery Hosting Platforms: To deliver your final images (e.g., Pixieset, Aryeo).

  • Payment Processors: To handle transactions securely (we do not store your credit card details).

  • Legal Necessity: If required by Florida law or to protect the safety of our team.

4. Data Security

We implement administrative and technical safeguards to protect your data. However, please note that no transmission over the internet is 100% secure.

5. Your Rights (CCPA/GDPR Compliance)

Depending on your location, you may have the right to:

  • Access the personal data we hold about you.

  • Request Deletion of your contact information from our marketing lists.

  • Opt-out of cookies via your browser settings.

6. Updates to This Policy
